Privacy Policy

Flowabl ("Flowabl," "we," "us," or "our") operates the Flowabl platform at flowabl.com and related services (the "Service"). This Privacy Policy describes how we collect, use, disclose, and protect personal information of users of the Service and of the clients, leads, and contacts our users communicate with through the Service ("Contacts"). By using the Service, you agree to this Privacy Policy.

1. Information We Collect

  • Account information: name, email address, mobile phone number, business name, role, billing information, and login credentials.
  • Contact information you upload: names, email addresses, mobile phone numbers, property addresses, transaction details, and notes about your Contacts.
  • Content: messages, documents, signatures, intake forms, offers, photos, videos, and other content you create or upload.
  • Usage data: log data, device identifiers, IP address, browser type, pages viewed, and timestamps.
  • Cookies and similar technologies for authentication, preferences, and analytics.

2. SMS / Text Messaging

By submitting any form on this site or providing your mobile phone number, you agree to receive SMS messages from Dominic with North Hills Realty regarding property updates, transaction updates, showings, and related real estate services. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe and HELP for assistance.

If you (as a Flowabl user) send SMS messages to your own Contacts through the Service, those Contacts must have separately consented to receive text messages from you.

Mobile Information & Non-Sharing

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors supporting Service operations (for example, our SMS delivery provider) is permitted only to deliver messages you have requested. Mobile opt-in data and consent are not shared with anyone for any other purpose.

Message Frequency

Message frequency varies based on your account activity and the notifications you enable. You may receive recurring messages, including up to several messages per day during active transactions.

Message and Data Rates

Message and data rates may apply. Standard message and data rates from your mobile carrier apply to all messages sent or received. Flowabl is not responsible for charges from your wireless carrier.

Opt-Out and Help

You can opt out of SMS messages at any time by replying STOP to any message. For help, reply HELP or contact support@flowabl.com. Carriers are not liable for delayed or undelivered messages.

3. How We Use Information

  • To provide, maintain, and improve the Service.
  • To authenticate users and secure accounts.
  • To send transactional, account, and Service notifications by email and SMS.
  • To process payments and manage subscriptions.
  • To respond to support requests.
  • To comply with legal obligations and enforce our Terms.

4. How We Share Information

  • Service providers who process data on our behalf (hosting, database, payments, email delivery, SMS delivery, analytics) under contractual confidentiality and security obligations.
  • Your collaborators: assistants, team members, or Contacts you explicitly grant access to.
  • Legal and safety: when required by law, subpoena, or to protect rights, safety, and property.
  • Business transfers: in connection with a merger, acquisition, or sale of assets, subject to this policy.

We do not sell personal information. We do not share mobile phone numbers or SMS opt-in data with third parties for their own marketing.

5. Data Retention

We retain personal information for as long as your account is active or as needed to provide the Service, comply with legal obligations, resolve disputes, and enforce agreements.

6. Security

We use industry-standard administrative, technical, and physical safeguards (including encryption in transit, role-based access controls, and row-level security on our database) to protect personal information. No method of transmission or storage is 100% secure.

7. Your Rights

Depending on your jurisdiction, you may have rights to access, correct, delete, or port your personal information, and to object to or restrict certain processing. To exercise these rights, email privacy@flowabl.com.

8. Children

The Service is not directed to children under 16, and we do not knowingly collect personal information from children.

9. International Users

The Service is operated in the United States. If you access it from outside the U.S., you consent to the transfer and processing of your information in the U.S.

10. Changes

We may update this Privacy Policy from time to time. Material changes will be communicated by email or in-app notice.

Terms & Conditions

These Terms & Conditions ("Terms") are a binding agreement between you ("you," "User," "Agent") and Flowabl ("Flowabl," "we," "us," or "our") and govern your access to and use of the Service. By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility & Accounts

You must be at least 18 years old and legally able to enter into contracts. You are responsible for the accuracy of your account information, for safeguarding your credentials, and for all activity under your account. Notify us immediately at support@flowabl.com of any unauthorized use.

2. Subscription, Fees & Trials

Paid plans are billed in advance on a recurring basis until cancelled. Fees are non-refundable except as required by law. We may change pricing on prospective renewals with at least 30 days' notice. Trials, if offered, automatically convert to a paid plan unless cancelled before the trial ends.

3. Acceptable Use

You agree not to, and not to permit anyone to:

  • Violate any law, regulation, or third-party right;
  • Send spam, unsolicited marketing, or messages without proper consent;
  • Upload malware, attempt to breach security, or interfere with the Service;
  • Reverse engineer, scrape, or use the Service to build a competing product;
  • Misrepresent your identity or affiliation;
  • Use the Service for activities prohibited by mobile carriers, including SHAFT content (Sex, Hate, Alcohol, Firearms, Tobacco), high-risk financial services, or illegal substances.

4. Client Communications & SMS / Text Messaging Consent

The Service enables you to send email and SMS text messages to Contacts. You acknowledge and agree that sending SMS messages is heavily regulated and that you are solely responsible for complying with all applicable laws, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, CTIA Messaging Principles & Best Practices, and applicable state and international laws.

4.1 Consent Requirements

Before sending any SMS message to a Contact through the Service, you represent and warrant that you have obtained prior express written consent from that Contact to receive text messages from you for the purpose, frequency, and content of the messages you send. Records of consent must be retained by you for at least four (4) years.

4.2 Required Disclosures to Your Contacts

When obtaining consent, you must clearly disclose to the Contact:

  • Your identity (the sender) and the purpose of the messages;
  • That message and data rates may apply;
  • The expected message frequency;
  • How to opt out (e.g., reply STOP) and how to get help (reply HELP);
  • A link to your privacy policy and terms.

4.3 Opt-Out Handling

You must immediately honor any opt-out request (including STOP, UNSUBSCRIBE, CANCEL, END, QUIT) and cease all non-transactional messaging to that Contact.

4.4 Indemnification for Messaging

You agree to indemnify, defend, and hold Flowabl harmless from any claims, damages, fines, or penalties (including TCPA statutory damages and carrier fines) arising from your messages, your failure to obtain proper consent, or your violation of this Section 4.

5. Your Content & Contact Data

You retain all rights in the content and Contact data you upload ("Your Content"). You grant Flowabl a worldwide, non-exclusive license to host, process, transmit, display, and back up Your Content solely to provide and improve the Service.

6. Real Estate Licensing & Professional Responsibility

You are responsible for ensuring that your use of the Service complies with all applicable real estate licensing laws, brokerage policies, MLS rules, advertising regulations, and fair housing laws. Flowabl is a software tool and does not provide legal, brokerage, or real estate advice.

7. Third-Party Services

The Service integrates with third-party services (e.g., payment processors, SMS providers, mapping). Your use of third-party services is governed by their own terms.

8. Intellectual Property

The Service, including all software, designs, trademarks, and content provided by Flowabl, is owned by Flowabl or its licensors. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your internal business purposes.

9. Suspension & Termination

We may suspend or terminate your account immediately and without notice if you violate these Terms, create risk or legal exposure for Flowabl, or fail to pay fees. You may cancel at any time from your account settings.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. FLOWABL DOES NOT GUARANTEE THE DELIVERY OF ANY EMAIL OR SMS MESSAGE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLOWABL AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID FLOWABL IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless Flowabl from any claims arising out of or related to (a) Your Content, (b) your use of the Service, (c) your messages to Contacts, (d) your violation of these Terms, or (e) your violation of any law or third-party right.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Florida. Any dispute will be resolved by binding arbitration in Miami-Dade County, Florida. You waive any right to a jury trial and to participate in a class action.

14. Changes to the Terms

We may modify these Terms at any time. Material changes will be communicated by email or in-app notice. Continued use of the Service after the effective date constitutes acceptance.
